Main definitions

dea-art.com is internet site for online selling and buying artworks. The gallery has specific purpose - presenting artworks of bulgarian artists. All artworks in dea-art.com are original artworks, published by artists or current owners. All prices include VAT. The delivery price is not included in the artwork price.

"User" is every one, who has visited the website dea-art.com .

"Seller" is everybody, who is publishing artworks in the art gallery

"Order" is the request for buying the selected artworks under the conditions, provided in the website concerning the way of delivery and payment by the User.

"Services" are all actions done by dea-art.com when and/or on occasion of offering, sale and delivery of the artworks from the website.

Preamble

The present document contains the general conditions, in accordance with which dea-art.com offers Services to its Users via the website. Every user is bound by the rules of the present general conditions for the whole period of use of the website, from the first entry to the leaving of the website.

The general conditions are published at a central place at the website and are visible and available for each User.

Subject of sale

Subject of sale are the artworks, presented on the site in the moment of making the order.

The artworks, the gallery is selling, are described with the following characteristics: picture, size, materials and the technic used, �����, is the artwork framed. dea-art.com is not responsible for possible differences in the colours of the bought artworks, which could be due to some specifications of the PC monitors. The statement for buying a Artwork is accepted for a pronounced consent by the User with regard to their type and quality.

Rights and obligations of the User

The user has the right to examine, order and receive Artwork/ Artworks from the website in the way and under the conditions, which are set forth in it.

The user has the right to inform himself for the state of his Order.

The user has the right of delivery of the ordered Artwork/ Artworks and at the submitted address for delivery, after he has paid the sale price in the way, indicated in the website.

The user has the right to request invoice for its Order.

The user has to pay the price of his Order in accordance with the specified by the website way.

The users of the site can not disseminate, change (edit), copy (unless for non-commercial, personal purposes), give, exhibit, reproduce, publish, create secondary materials, transfer, sell or by any other means use the contents of the website without the explicit written permission of dea-art.com .

Rights and obligations of the Seller

The Seller has the abligation to present ordered artwors to dea-art.com in time.

Each User, irrespectively if he has done an Order or not, is obliged when using the Services:

- not to violate and to obey the rights and freedoms of the citizens in accordance with the Constitution, the laws of Republic of Bulgaria and the international acts to which it is a part, the rights of the ethics, the etiquette and the netiquette when using the offered by dea-art.com Services;

- not to break others property or non-property, absolute or relative rights and interests, as right of property, right of intellectual property and others;

- to inform dea-art.com and the relevant authorities immediately for each case of violation done or found when using the offered Services;

- not to do malicious actions.

Rights and obligations of dea-art.com

dea-art.com hasn�t got the obligation and the objective ability and doesn�t control the way the Users use the offered Services.

dea-art.com is entitled, but is not obliged to keep materials and information used / placed on the server of dea-art.com or made available to third parties by the User and to grant them to third parties or the relevant state authorities in the cases when that is necessary for observing the rights and the legal interests, the property and safety of dea-art.com, as also of third parties, in the cases of claims laid in relation with the violation of their rights on occasion of used or disseminated information or materials, as also in the cases, when the materials or the information are being demanded by the state authorities by the virtue of an explicit legal regulation.

dea-art.com has the right at any time, without notifying the User when he uses the Services in violation of the present conditions, as also in Dea Art�s own judgement, to discontinue, stop or change the offered Services. dea-art.com is not liable toward the Users and third parties for damages suffered and benefits lost as a result of discontinuation, stopping, changing or restriction of the Service, erasing, modification, loss, lack of authentication, inaccuracy or incompleteness of messages, materials or information, carried by, used, recorded or made accessible through dea-art.com.

The user is obliged to compensate dea-art.com and all third parties for all damages caused and benefits lost, including all costs and paid lawyer�s fees, which have occurred as a result of claims laid and/ or compensations paid to third parties with regard to websites, hyperlinks, materials or information, which the User has used, placed on the server, sent, disseminated, brought to third parties's knowledge or made available via dea-art.com in violation of the law, the present general conditions, the etiquette and the netiquette.

Changing the general conditions

The general conditions can be changed any time by dea-art.com and the same is obliged to notify the User for the changes in the general conditions by publishing on the website a notification for the changes and specifying a proper time limit for becoming acquainted with them. In the given time limit, if the User does not declare, that he refuses the changes, he is to be considered bound by them. In case that the User declares within the time limit that he does not accept the changes, dea-art.com is entitled immediately to stop or discontinue the delivery of the Services to the User. The arising to that moment obligations are subject to execution.
